Terms of Service

These Terms govern your use of the McQueen Roofing website and estimating tools (the “Service”). By using the Service you agree to them. If you do not agree, do not use the Service.

1. Who we are

The Service is operated by McQueen Roofing (“McQueen”, “we”, “us”). You can reach us at duncan@startupmaphub.com.

2. What the Service does

McQueen produces itemized cost estimates for roofing work. Estimates are generated from the inputs provided — roof footprint, pitch, material grade and similar details — combined with general material and labor pricing.

Where the Service offers to derive details from a property address, any figure produced that way is an assumption based on typical properties, not a measurement of your roof. We do not inspect, survey, or measure any property.

3. Estimates are not quotes, bids, or professional advice

This section is important, so it is stated plainly:

• An estimate produced by the Service is informational only.
• It is not a quote, bid, offer, or contract for roofing work, and it does not bind us, you, or any contractor.
• It is not a substitute for a professional inspection by a licensed roofing contractor, engineer, or inspector.
• It is not an insurance appraisal and should not be relied on when settling a claim.
• Actual costs vary with local labor rates, material availability, permits, code requirements, access, and conditions that cannot be seen until a roof is opened up.

Do not make a purchasing, contracting, insurance, or financing decision on the strength of an estimate alone. Have the work priced by a qualified contractor who has physically assessed the property.

4. Eligibility

You must be at least 18 and able to form a binding contract. If you use the Service for a business, you confirm you are authorized to accept these Terms on its behalf.

5. Accounts

Some features may require an account. If you create one, you agree to provide accurate information, to keep your credentials confidential, and to be responsible for activity under your account. Tell us promptly at duncan@startupmaphub.com if you believe it has been compromised.

6. Plans, fees, and trials

Homeowner estimating features are free. Paid contractor plans, where offered, are billed in advance on a recurring basis at the price shown at sign-up, and renew automatically until cancelled.

• You may cancel at any time; cancellation takes effect at the end of the current billing period.
• Except where required by law, fees already paid are non-refundable.
• Where a free trial is offered, we will tell you its length and what happens when it ends before you start it.
• We may change pricing on notice. Changes take effect at your next renewal, never mid-period.

Prices displayed on the site are current intentions and may change before a plan becomes purchasable.

7. Acceptable use

You agree not to:

• use the Service unlawfully, or to produce estimates you know to be misleading;
• present an estimate to a third party as though it were a professional inspection, appraisal, or our endorsement of a price;
• scrape, bulk-download, resell, or redistribute the Service or its output as a competing product or data set;
• reverse engineer, probe, or interfere with the Service or its security;
• upload anything unlawful, infringing, or malicious; or
• use the Service to send unsolicited commercial messages.

8. Your content

You keep ownership of what you put into the Service — measurements, documents, business details, logos. You grant us a limited licence to host and process it for the purpose of operating the Service and producing your estimates. We do not claim ownership of your work product, and we do not sell your content.

Estimates you generate are yours to use with your customers. The underlying software, pricing logic, templates, and site content remain ours.

9. Contractors and homeowners

McQueen is not a party to any agreement between a homeowner and a contractor. We do not perform roofing work, do not employ or supervise contractors, and do not warrant any contractor's licensing, insurance, workmanship, pricing, or conduct. Any introduction or matching feature is a convenience only. Verify licensing and insurance yourself before hiring anyone.

10. Availability and changes

We may change, suspend, or discontinue any part of the Service. We aim to give reasonable notice of material changes but the Service is provided on an as-available basis and may be interrupted for maintenance, upgrades, or causes outside our control.

11. Disclaimer of warranties

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty as to the accuracy, completeness, or reliability of any estimate or other output. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

12. Limitation of liability

To the fullest extent permitted by law, McQueen Roofing will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or cost of substitute services, arising out of or relating to the Service — including any difference between an estimate and the price actually charged for roofing work.

Our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) one hundred US dollars (US$100).

13. Indemnity

You agree to indemnify and hold harmless McQueen Roofing and its officers, employees, and agents from claims, losses, and reasonable legal fees arising from your use of the Service, your content, your breach of these Terms, or your dealings with any contractor or customer.

14. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or if we reasonably believe your use creates risk or legal exposure. Sections that by their nature should survive termination — ownership, disclaimers, limitation of liability, indemnity, and governing law — will survive.

15. Changes to these Terms

We may update these Terms. We will change the “Last updated” date above, and for material changes we will provide additional notice where practicable. Continuing to use the Service after an update means you accept the revised Terms.

16. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. You and McQueen Roofing agree to the exclusive jurisdiction of the state and federal courts located in Delaware, except that either party may seek injunctive relief in any court of competent jurisdiction. Nothing here removes any right you have to bring a claim in a small claims court, or any mandatory consumer protection right available to you where you live.

17. General

These Terms, together with the Privacy Policy, are the entire agreement between us regarding the Service. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
